UNDERSTANDING WHAT'S AT STAKE WITH THE "FAIR SHARE" FEES AND THE PENDING DECISION BY THE U.S. SUPREME COURT Janus v. AFSCME is a public sector case challenging the legality of requiring public employee non-members (in non-Right to Work states) to pay "fair share" fees for workplace representation. On February 26, 2018, the United States Supreme Court heard arguments by attorneys supporting the forty-year precedent permitting such payments, as well as those funded by corporations and wealthy Americans seeking to change the status quo. A decision is due to be issued no later than June of this year. If the Court overturns existing law, it will have significant impact on state and local public employees.
